Relocation of street lights

The municipalities of the Amt Mönchgut-Granitz are required to provide adequate and sufficient lighting in public traffic areas as part of their traffic safety measures. The location of a street light depends on various factors, e.g. the luminosity of the light fitting, the height of the mast, the number of lights in a certain area, the property boundaries, etc.

The luminaire locations are or were determined on behalf of the municipalities by specialist planners as part of lighting projects or as part of maintenance by experts from the municipal contractors, taking all factors into careful consideration. In principle, residents must tolerate a street light in front of their property or in the immediate vicinity. It is possible to relocate a luminaire at the request of residents, but this can only be done if this does not cause any disadvantages for the general public.

The relocation of a street light must be applied for informally in writing at the local authority, Building Department, Civil Engineering Department, Göhrener Weg 1, 18586 Baabe. The application must include at least one site plan showing the location of the lamp (municipality, street, Hs no., footpath, verge, property boundary, etc.). The reason for the relocation must be plausibly described. The new luminaire location will then be determined locally with the specialists from the municipal electrical companies, who will also carry out the installation work. However, there is no legal entitlement to relocation. All approvals are based on case-by-case decisions. The municipality decides on the final relocation of a lamp.

The location of the luminaire is decisive for the assumption of costs:

1. the street light is demonstrably located on private property
A street light should always be located in the public traffic area. If the luminaire was installed on your private property in previous years without a separate agreement, it can be relocated to the public area at the municipality's expense if it has to be relocated with sound justification. Otherwise, public lamps on private property are protected. Lamps on private property can also be relocated on request, without stating special reasons. In this case, however, the relocation is at the expense of the applicant.

2. the street light is located on public property
In this case, the polluter pays principle applies, i.e. if you as a resident wish the light to be relocated, for example to create another access road to your property, you must also bear the costs for the necessary work. The amount of the costs depends on the amount of work required. This depends on the local conditions and is therefore difficult to quantify in advance. On average, however, costs of € 1,000.00 to € 1,500.00 can be expected. The applicant must provide written confirmation that the costs will be covered before the work begins. The local authority will then send you the invoice after completion with a request for payment.

If you have any further questions, please do not hesitate to contact the civil engineering department.

Note: Administrative activities may be subject to charges. The legally valid administrative fee statutes of the Mönchgut-Granitz Office apply.
